Montana injustice and corruption

More about this campaign

The United States of America has more people in prison per capita, than ANY OTHER COUNTRY in the world. Some of county and state court systems, especially in Montana have developed into funding sources for Private Prison profits, as well as an easy way to help line the pockets of their investors and stock holders of these corrupt prisons systems.
Montana currently had a State Senator request the Federal Government to look into Montana's Privately owned Prisons. Montana's population is a little over 1 million people, but this beautiful State has 4 Privately Owned Prisons, 1 covering 20 square miles, while another $27 million prison is trying to be opened up in Harden, Montana
We at montanainjustice.blogspot.com want to help stop some of this corruption and straighten out some of the vague and corrupt laws. Montana is the only state in the whole country,if God forbid, you are brought up on felony charges that you are not given a grand jury indictment or preliminary hearing guaranteed under the  5th and 14th amendments of the Constitution of the United States of America. The only evidence needed to keep you in jail is the "word" of the District Attorney.
Judges and Lawyers can be held accountable and laws can be changed, but it is not easy. We are not from wealthy or well to do families. Any time volunteered  or money spent on legal paperwork, calls, books or legal questions needed to help show some of these cases have came from our own limited and small friends and family network.

We ourselves have a relative who was sentenced to 10 years in prison in Montana. This case shows the outright and open corruption that happens every day in the Montana courts. This is the reason why we started Montanainjustice.blogspot and these Booster pages. His case is DA-14-0639.l  Here are just a few things his judge did.
     1) He was never given the option or waiver of the constitutionally guaranteed right of a preliminary hearing or grand jury indictment
      2) The day he plead guilty the judge did not even have a signed waiver of rights, or a signed plea agreement filed into court. This is admitted in open court by his lawyer.
      3)  The judge did not get a factual basis for his guilty plea.
      4)  The judge incorrectly used a defined designation ( habitual traffic offender ) out of context. This was used for justification of the maximum sentence.
       5) The judge never allowed him to say something in his own defense. or to address the court before being sentenced to 10 years in prison.
        6) The judge did not recite, as required by law, or  he misapplied  State statues and Constitutional Amendments. These are, but not limited to Amendments
5,6, 8 and 14 of the United States Constitution. Article 2, Section 17, Article 2 Section 24, of Montana's own Constitution. State Statutes 46-18-102, State statue 46-16-105,   46-18-115,   46-12-210,  46-12-211 (1),  46-12-211 (2), 46-12-214, 46-12-204, 46-12-212(1) and (2). He has a State appointed Appellate defender and THIS DEFENDER REFUSES to bring any of this up on his appeal.
